La trentaine, Fatou Diop a échappé hier à une condamnation de prison ferme, du fait de sa déficience mentale. Et pourtant, rien ne montrait qu'elle ne jouissait pas de toutes ses facultés mentales, avant que ses parents ne déposent sur le bureau du procureur des actes attestant qu'elle souffrait de démence.
C'est ainsi que le tribunal a décidé de proroger le délibéré dans l'affaire la concernant pour finalement la relaxer de toutes poursuites. Au mois de janvier dernier, Fatou Diop qui avait menacé à maintes reprises de tuer Arame Fall, l'épouse de son ex-mari, passe à l'acte. Elle surprend Arame Fall en train de faire la cuisine dans la cour du domicile familial et lui assène un violent coup de pilon. Celle- ci tombe en syncope et s’affale. Loin de s'en arrêter là, elle lui mord le doigt avec une violente telle qu'elle finit par la sectionner. Alerté par le bruit, le mari de la victime, Ablaye Diouf, accourt pour porter secours à son épouse. Mais il reçoit à son tour un coup de pilon sur le dos de la part de Fatou Diop. Fort heureusement, il réussit à la maîtriser avant d'alerter ses voisins. Ce sont ces derniers qui ont appelé les sapeurs-pompiers.
Informés, les éléments du commissariat spécial de Touba descendent sur les lieux et embarquent Fatou Diop. Devant les enquêteurs, la mise en cause a reconnu avoir attaqué l'épouse de son ex-mari, au motif que celle-ci la narguait constamment. Présentée au procureur au terme de la durée légale de sa garde-à-vue, Fatou Diop a fait l'objet d'un mandat de dépôt.
Devant la barre du tribunal, elle a réitéré ses aveux circonstanciés faits à l'enquête et devant le magistrat instructeur. Alors que le procureur s'est rapporté à la clairvoyance du tribunal, la plaignante Arame Fall a réclamé 300 000 FCfa en guise de dommages et intérêts et à son mari, un demi million FCfa. Finalement, ils ont été déboutés de leurs demandes après que le tribunal a prononcé la relaxe en faveur de la prévenue Fatou Diop, pour cause de démence.
